Information about the New Mexico Crime Victims Reparation Commission and how to apply for financial assistance.

Crime Victim Compensation is a viable source of financial assistance to a victim that should not be overlooked for out-of-pocket expenses that might occur as a result of the crime. It is important for victims and claimants to file a compensation application even if the victim has other sources, such as health insurance, that can cover medical expenses.

How Does a Person Qualify?

  • The crime must have occurred in New Mexico.
  • The crime must be reported to a licensed medical provider, licensed mental health provider, tribal health provider or law enforcement agency.
  • A completed application must be filed within two (2) years of the incident. Some exceptions may be allowed for good cause.
  • The victim or claimant must cooperate fully with New Mexico Crime Victims Reparation Commission.

Who May Apply?

  • Victims
  • Family and dependents of deceased victims
  • Any individual who voluntarily assumes funeral or medical expenses of the victim

Eligible Crimes

Victims who have suffered physical injury or extreme mental distress as a result of one or more of the following crimes:

Arson resulting in bodily injury
Aggravated assault or aggravated battery
Dangerous use of explosives resulting in bodily injury
Negligent use of a deadly weapon
Murder
Voluntary manslaughter
Involuntary manslaughter
Kidnapping
Criminal sexual penetration
Criminal sexual contact of a minor
Homicide by vehicle or great bodily injury by vehicle
Abandonment or abuse of a child
Aggravated indecent exposure
Stalking
Human trafficking
Assault against a household member
Battery against a household member
Failure to give information and render aid

Types of Eligible Expenses

Benefits up to a maximum of $20,000 can be made for the following:

Medical and dental care
Mental health counseling
Other medically necessary devices
Funeral and burial expenses
Loss of earnings as a result of the crime
Reimbursement of co-pays
Travel for medical appointments and court dates

No benefits are made for property loss, pain and suffering, or attorney’s fees.
